Business Immigration to Canada

The Government of Canada considers the business immigrants according to their potential of establishing themselves in Canada while contributing to or supporting the development of Canada’s economy. Start-up/Entrepreneur Visa Program

Various entrepreneur programs allow the immigrants to benefit from Canada’s growing economic potential for obtaining permanent residence in Canada for themselves and their family.
To begin with assessing your eligibility under this program, you must make sure to have

  • The promise of support from Canadian venture capital fund, angel investors or business incubators;
  • Communication abilities in English or French or both the languages; and
  • Sufficient financial support to get settled and cover for the cost of living in Canada before starting to earn from the business;
  • The net worth of at least C$300,000 and the experience of having managed a business while controlling at least 33.33% of the qualifying business for minimum 2 years before not more than five years of applying for Canada immigration;
  • Offering active management of the Canadian business under consideration;
  • Ability to create one or more incremental full-time job for one or more Canada citizens or permanent residents other than the immigration applicant and their immediate families.

While assessing the applications, the key traits of the applicants that are taken into account, are

  • Their age
  • The nature and duration of their training
  • Their language skills
  • Their personal qualities and your knowledge of the region

The approach followed by the applicant to acquire a business in the region and their ability to carry out a business project will be the key elements in the assessment. The Entrepreneurial applicants are needed to sign a statement that they take the responsibility for meeting the conditions for the Canadian Permanent Residence. All the family members of the entrepreneurship applicant are accepted under the same conditions as the applicant. Once the main applicant meets those conditions, the conditions do not apply anymore for the family members.

Investor Visa

The investor applicants for the Canadian Visa can avail permanent residence in Canada according to the type of investor visa they choose to apply for. However, the Federal Immigrant Investor Program is no more operational since 2014, which has limited the options available for such candidates to apply for residence by means of sheer investment in Canada. Yet, there are some Provincial Nominee Programs (PNPs) that offer the Investor Category to apply in, for these candidates.

Here are two of such provincial – investor visa programs:

  • Manitoba Business Investor Stream

To apply for Manitoba Business Investor Stream and receive an investor visa to the province, there are two ways: the Business Investor or Entrepreneur Pathway and Farm Investor Pathway. The applicants interested to start up, buy or co-own a business in the province, can opt for the Entrepreneur Pathway, whereas those who are interested in buying and managing a farm in the rural parts of the province, can opt for the Farm Investor Pathway.

The Business Investor
(Entrepreneur) Pathway

The Business investor stream aims to encourage individuals to start their business in the province of Manitoba and generate employment for the citizens and the permanent residents to contribute the economy of the province.

The program allows the province to recruit people with skills and experience in starting up, buying and managing businesses. Along with the will and ability to move to and settle in the province of Manitoba for themselves and their dependents, the individuals must meet the following eligibility requirements:

  • A minimum of three years of full-time business ownership or management experience achieved within the last five years. The business owners with control over a third of the equity of the business are preferred over the business managers.
  • The score must be at least a CLB/NCLC 5.
  • The education should be equivalent to the high school certificate of Canada.
  • With no specific age limit, there are ranking days awarded for the age range of 25-49.
  • The minimum capital requirement for the Capital region in Manitoba is C$250,000 and for any other region, it is C$150,000.
  • The business investment shall be made in a business that qualifies for the Manitoba Provincial Nominee Program (MPNP).
  • The new business should be able to generate and/or maintain at least one job for a Canadian citizen or permanent resident of the province.
  • A business plan is required to be submitted as a part of the application which is based on an extensive research conducted in a business research visit paid within a year of your showing expression of interest to the program.
  • Extra points are awarded to the applicants who demonstrate ease of relocating to the province in terms of employment history in the province, moving to the province with the family, and their ability to speak either French or English or both the languages.
  • The required personal net worth is of C$500,000.

Once the application gets the approval, the applicant signs a Business Performance Agreement (BPA) for MPNP to issue a letter of support for them, allowing them to apply for the work permit.

Farm Investor Pathway

To opt for this pathway, the applicant needs to have proven experience in farm business and the required capital to invest along with the will to start up and run the farm business operations in the rural parts of the province of Manitoba.

The program is aimed for recruiting the candidates to contribute to the production of primary products in line with the province’s existing farm industry. The operations and investment are planned in line with the provincial statistics of the farm industry of Manitoba. Here are the minimum eligibility requirements for the applicants opting for farm investor pathway:

  • Minimum three years of farm ownership, operations and management experience.
  • The language skills in either French or English or both.
  • The minimum investment of C$300,000 and the farm business in rural Manitoba.
  • The investment is needed to be made in the tangible assets as ascribed by MPNP.
  • Submitting a farm business plan based on a Business Research Visit made to the province.

For this program, you are required to live in the farm and participate actively in managing it on a regular basis.

  • The farm requires to be active and economically viable in its primary agriculture production with regular and recurring business activities in rural Manitoba.
  • The applicant needs to have skills and experience in farming which is in line with Manitoba’s current primary farm production industry.
  • The required personal net worth is of C$500,000

With a business activity that can contribute to the economy of Ontario province, the applicants can opt for the Ontario Corporate stream. This program does not only allow the applicants to apply for residence permit but it also allows their key staff to apply work permit once their business proposal gets approval from the OINP.

Here are the different categories of the eligibility requirements for the individuals to consider this program:

  • Corporation
  • The applicants should ensure to have established their business at least 36 months before submitting the application:
  • The corporate structures that can be considered for this program, are:
    • Public corporations;
    • Partnerships; and
    • Sole proprietorship
  • Investment
  • The minimum investment of C$5M is required for your business expansion in Ontario or buying an existing business in the province;
  • The investment needs to come from legally earned funds; and
  • The investment must be significantly beneficial for economy of the province.
  • Employment Creation
  • Against every key staff applicant, the business needs to generate five permanent and full-time employment opportunities for the permanent residents or citizens of Canada; and
  • The employments must be paid ones with the rates compliant with industry standards.
  • General
  • Additionally, there are some general requirements the applicants’ businesses need to fulfil:

  • The business to be started in Ontario should be directly linked with its parent company.
  • The new business needs to be considered as a permanent business in the province.
  • The new business should intend to profit from selling goods or rendering services.
  • The primary income for the business needs to be its active and earned income.
  • The business should comply with the relevant Ontario labour laws, Canadian legal practices, authorization and licensing. Any existing business the applicants intent to buy must be incorporated in the province.
  • The immigration schemes or immigration-linked schemes can not qualify for the proposed business idea. The applicants must submit a business plan.
  • The third party investors must be either institutional investors, or Schedule I or Schedule II banks.

The Federal Immigrant Investor Program is no longer operational as it has ended as on June 19, 2014 with the applications in the backlog also terminated. Self-Employed Program

For the applicants who are capable of generating their own employment based on their contribution to Canada’s economy and job-market by cultural, artistic or athletic means and skill-set, the self-employment program is perfect. For this program, the government of Canada considers the applicants based on availability of sufficient funds, skills and relevant work experience.

For qualifying for business immigration to Canada as a self-employed individual, the applicants need to prove their relevant cultural, athletic or artistic experience that empowers them to be self-employed. They must demonstrate their ability to make notable contribution to Canada. Here are the minimum eligibility requirements:

  • Personal minimum net worth of C$100,000 which is legally obtained;
  • Proof of relevant experience of minimum two years of self-employment or participation in culture, art, recreation or sports activities at a world class level, as listed by Citizenship and Immigration Canada;
  • The age, education, experience and language ability (for English and French) are assessed from the viewpoint of adaptability to Canadian culture; and
  • A minimum of two years of farm management experience for applicants willing to purchase a farm.
